• This (webpage/e-mail) serves as a working contract between ByOsmosis Consulting (ByOsmosis) and YOUR NAME, PHONE NUMBER AND ADDRESS HERE (Client).

• All invoices are payable within 30 days by check or money order to: ByOsmosis Consulting P.O. BOX 9605 OAKLAND CA 94613-0605

• This contract is valid for one year from date of agreement.

• All original artwork and web content remains the sole property of the Client. ByOsmosis respects copyrights as well as Client privacy.

HOSTING SERVICES

• ByOsmosis offers a feature-rich, industry-quality domain hosting packages as detailed in the accompanying documents. This contract covers the purchase of HOSTING PLAN domains, 25 e-mail addresses, 200 MB storage per domain. Hosting rates are $15 a month or $150 year. Customers purchasing a full year's service are entitled to a free domain registration within the same year. Additional services are available upon request, appropriate fees apply.

• ByOsmosis provides registration of new domain names for $15 per domain, per year. All domain registrations are binding, domain names cannot be switched or modified once purchased.

CONSULTING SERVICES

• ByOsmosis currently bills for consulting services at the following rates:
  • All 'regular' work is billed at $BILLING RATE per hour.
  • All 'emergency' (24 hour turn around) work is billed at 1.5 X the regular rate or $EMERGENCY BILLING RATE per hour.

• Initial Scope and Estimate: The initial project scope and estimate are included in the accompanying documents.

• Billing for consulting services will be done on a time and materials basis. Should the project appear to need additional time or budget beyond the estimate, ByOsmosis will inform Client accordingly.

• Unless otherwise requested, development will take place in an appropriate development environment. Once the final product is approved we will move the site to the production web server.

TERMINATION OF CONTRACT AND REFUNDS

• The consulting arrangement can be severed by either party for any reason with 30 days written notice. Client will be provided a final invoice for all consulting work completed to date.

• Hosting services can be terminated at any time with written notice. A refund of 50% the pro-rated value of the hosting contract will be provided within 30 days of termination.

• No refunds are provided for domain registration services once purchased.
